ScholarCentric makes every effort to maintain the privacy of any student information.

As part of the Success Highways curriculum, ScholarCentric will provide survey materials, their results, and a report of the findings to the Educational Institution. The surveys are titled Revving Up and Moving On. ScholarCentric warrants that the processing of the Revving Up and Moving On survey is conducted blindly, and ScholarCentric has designed such surveys so ScholarCentric and its agents will have no knowledge of the name, or other common identifying information of the student participant (with the exception of ethnic/race/gender information for reporting and research purposes.) ScholarCentric will not use individual student Confidential Information in any other way or make it available in any fashion to any third parties except to the extent necessary to comply with Recipient’s obligations under this Agreement or pursuant to Federal, state or local law. ScholarCentric will also destroy any physical student marked surveys in its possession within 60 days after processing such information. ScholarCentric may utilize the data gathered in the aggregate for any reason including but not exclusively contractual obligations with Educational Institution, academic and product research and development and/or advertising.

ScholarCentric reserves the right to publish the name of the Educational Institution to align with the aggregated data gathered therein. However, it will relinquish such right as soon as written notice by the Educational Institution involved is sent by U.S. Certified Mail to 600 17th Street, Suite 2800 South, Denver, CO 80202-5428.

PAYMENT TERMS
Payment is due 30 days after invoice. ScholarCentric will not ship goods or perform services until a written purchase order or similar document is received by ScholarCentric.

DISCLAIMER, REMEDIES AND LIMIT OF LIABILITY
ScholarCentric has placed a significant amount of effort and utilized a substantial amount of expertise to make sure that Success Highways is the best product possible and ready for use. However, we can make no promises that Success Highways is complete, error free, or that all of its components will be provided in a timely manner (due to circumstances beyond its control or for any other reason).

SUCCESS HIGHWAYS CURRICULUM AND SERVICES ARE PROVIDED BY SCHOLARCENTRIC TO THE EDUCATIONAL INSTITUTION “AS IS,” WITHOUT ANY WARRANTY OF ANY KIND INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUALITY, ACCURACY, AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.

If there are any issues with regard to the performance of any aspect of this purchase agreement, ScholarCentric, at its discretion will either attempt to remedy the deficiency or credit the Educational Institution. This will be the sole remedy of Educational Institution.

PRIVACY
ScholarCentric’s privacy policy is available for review at www.scholarcentric.com. Success Highways includes published materials such as individual survey results and a student workbook entitled My Success Roadmap in which students of the Educational Institution may or may not provide information that they or their parents deem sensitive in nature. The Educational Institution will take steps to assure that the information provided by students remains private (e.g. storing student workbooks in a secure place). The Educational Institution further acknowledges its responsibilities and agrees to take requisite steps to comply with federal, state and local law potentially including but not limited to the Family Educational Rights and Privacy Act (FERPA) 20 USC 1232g (1974), Protection of Pupil’s Rights Amendments (PPRA) 20 USC 1232h (1978), No Child Left Behind Act of 2001, Pub. L. 107-110, 115 STAT. 1425 (January 2002), among others over which ScholarCentric has no control.
